Booklet 12 -Self Government and Local Government

Self-government is the power to govern without requiring the approval of someone else. Kitsumkalum will have defined right to self-government once the Final Agreement is effective. This will include the power to govern what happens on our lands and the activities of our people and others on our lands. We will no longer be governed by the Department of Indigenous Affairs through the Indian Act.

An important step toward self-government is to create a constitution. The Kitsumkalum Constitution will establish the rules on how the government will operate.

Canadian Constitution s.91 (24):                                 Canadian Constituion s.35 and s.25:

Canadian and BC Governments
The Parliment of Canada can make 
laws that apply only to indigenous
people.
BC Laws made by the BC Legislature
also apply to indigenous people like

Band Council
Band councils have limited ability to
manage reserve lands and have to
report on activities to the Minister of
Indigenous Affairs.
The Minister has the power to remove
the authority of a band council by third

Indian Act By laws
Band Councils have limited law making
authority in the form of by laws.
Bylaws must be approved by the Minister. 

 

Local Governments
The Final Agreement will address the ways that Kitsumkalum and neighbouring local governments will work together on common interests, such as health care and education.
For example, today education and health care on reserves are the responsibility of the federal government. After the Final Agreement is effective, the Kitsumkalum government will be responsible for health care and education and may want to work with local governments or the province to provide these services.
Still being negotiated as part of the Final Agreement, are a seat on the boards of the North West Regional District and Coast Mountains School District 82. Kitsumkalum can also negotiate agreements on regional planning with neighbouring local governments, like the City of Terrace or the North West Regional District.
Kitsumkalum Lands will become part of the North West Regional Hospital District  and we will have a seat on the board of the House District.
